In its amicus brief, United Policyholders filed an amicus brief supporting policyholders challenging Progressive’s practice of reducing no-fault wage-loss payments through statutory offsets while simultaneously counting the larger pre-offset amount toward exhausting policy limits. UP argued that this approach violates policyholders’ reasonable expectations and the insurer’s duty of good faith and fair dealing because insureds reasonably expect their coverage limits to be reduced only by benefits they actually receive.
