UP’s Amicus Curiae Letter in Support of Petition for Review, or in the alternative Request for Depublication of Villanueva v. Fidelity National Title Co., S252035; published at (2018) 26 Cal.App.5th 1092 . Villanueva for the first time, strips California consumers of all rights to monetary relief when insurers charge unfiled, unapproved insurance rates, or otherwise charge rates in violation of the Insurance Code. UP strongly advocates in this letter that the Supreme Court grant review and take a careful look at the Villanueva decision and its effect on insurance consumers. However, in the alternative, at the absolute minimum, UP advocates for the opinion to be depublished.
