At fault insurance company, is asking for confirmation of my insurance policy at time of accident

I was involved in a serious accident where my vehicle was T-boned and later deemed totaled. As a result, I sustained injuries to my neck, back, and shoulder. I sought immediate medical attention at Kaiser Permanente, where both X-rays and an MRI revealed injury-related damage.

Insurance Communication Summary

Reported to AAA: I promptly reported the accident to my insurer (AAA) and provided a recorded statement. During this conversation, I mentioned that I occasionally drive for DoorDash. At the time of the accident, I was driving to pick up an order, but I was not actively working or earning income during that drive. I clarified that I only get paid after picking up and delivering the order—this drive was equivalent to a commute.

At-Fault Insurance (Farmers): A few days later, Farmers contacted me to take my statement and confirmed that they are accepting 100% liability for the accident. I submitted my medical reports to their portal as requested. However, I was later informed by the adjuster that the records I provided cannot be used—they must come directly from Kaiser, requiring me to sign a medical release form.

AAA Policy Verification: The Farmers adjuster also requested my AAA policy, which I provided. However, she then informed me that she needed confirmation from my AAA adjuster regarding my coverage status, which has created further delays.

Concerns and Issues

It has now been over a month since the accident, and aside from the payout for my totaled vehicle, I have seen no progress toward resolving my medical claim or receiving compensation for my injuries. I am still experiencing persistent pain and require timely medical care, but treatment from Kaiser has been slow, and I cannot afford to pay out of pocket.

Additionally, the lack of communication from both insurers for the past two weeks has left me unsure about the status of my claims or the next steps.

Request for Immediate Action

AAA: Please confirm the status of my coverage under my policy. If additional information is needed, kindly let me know what is required to avoid further delays.

Farmers: Please confirm receipt of the medical release form (if needed) and provide a timeline for resolving my claim.

Both Insurers: I kindly ask that both companies coordinate promptly to prevent further delays in my medical treatment and settlement.

Dear Robert,

We wish you a full and speedy recovery and are sorry to hear about your accident.  Typically, when you have an injury, the at fault carrier will monitor your claim and only settle your claim, including addressing medical bills, when you are stabilized and/or done with treatment.  The adjuster must also complete their own investigation, which can involve securing a copy of your policy from your own insurance carrier.

Since you are still being treated for injuries, your claim is still ‘active;’ the carrier is not going to address your medical bills or settle your claim.

When you are stabilized and/or done being treated, the carrier will secure your medical bills and treatment records from your provider directly to review for claim settlement. It is common that the carrier request these invoices and treatment records from your provider directly.

The claims resolution process does take time. Be prepared that it will take longer than you expect.

You may want to check your own policy to determine whether or not you have Medical Payment or Personal Injury Protection (PIP) coverage – this may cover your medical expenses while you are still treating.

Be well,

Alexis Ricci
