I have a follow-up question: How does this apply in the case of owners of condominium units? The Coverage A on their policies only cover things like appliances and light fixtures – not the actual “dwelling structure.” The dwelling structure itself is covered on the Home Owners Association policy. Are condominium unit owners therefore entitled to 30% of the Coverage A on the Home Owners Association policy?

The CA Insurance Code 10103.7.(b)(1) entitles an insured to 30% of Coverage A (up to $250,000) towards Personal Property Damage, in the event of a declared disaster and total loss.

We recommend that you speak directly with your HOA representative and insurance adjuster to confirm how the CA Insurance Code applies to the Unit Owner policies, which would have considerably lower Coverage A limits than the typical Homeowner policy. We would hope that the carrier would consider 30% of the Coverage C limits in lieu of a lower 30% Coverage A limit for personal property total loss advances.
