California FAIR Plan – 100% Unresponsive

Hello – I am assisting my in-laws with their property claim with California FAIR – we filed the claim immediately — and initially had contact with an assessor who advised us that they would be receiving initial disbursements in short order. They have now gone 100% radio silent and have not responded to multiple emails/phone calls etc (it’s been more than 10-days). Does anyone have a way to escalate this to proper officials/authorities?I have full permission to representant them — all payments will be going to them — however, they are quite old and this is just adding to the confusion/disorientation of the situation. It is very clear they are dealing with a heavy claim volume — but lack of any response for a prolonged period is infuriating.

Hi Justin,

We are sorry your family is going through this situation. Unfortunately, FAIR plan along with other carriers, has high claims volume and response times will be very slow. We recommend that you continue doing what you are currently doing – calling and emailing your adjuster daily, if needed. Keep a journal of these interactions and you can try also drafting a letter to the carrier to send with your emails. Under the California Fair Claims Settlement Practices Regulations, section 2695.5, a carrier has 15 days to respond to your communication.
