Statute of Limitations in California for filing claims due to displacement regarding CZU fire

Hi,

Thanks for your answer to my evacuation question, and for further clarification, our home is in the CZU fire area. Our property was not burned, but we were evacuated for weeks. We have had many subsequent evacuations due to threat of landslide. We have also been evacuated for state of emergency due to weather regarding high wind advisories which also effect us because we’re near the top of a ridge. Are these all covered under Loss of Use?

Thanks,

California law does allow you to make a claim for expenses if a government entity has ordered evacuations in your area, and because the recent threats related to landslides potentially proximately caused by wildfire damage.

(c) For a loss that is otherwise not subject to paragraph (1) or (2) of subdivision (b), in the event of a state of emergency, as defined in Section 8558 of the Government Code, that is accompanied by an order of civil authority restricting access to the home, related to a covered peril, additional living expense coverage shall be provided for at least two weeks. Additional extensions of two weeks shall be provided to a policyholder for good cause, but shall be subject to other policy provisions. Ca. Ins. Code § 2060

Hope that helps!
