1-We have flood insurance (& homeowners). Our insurance, USAA, denied because they called it “groundwater.” It never was underground. The source is the pool. It barely crossed the soil. This is a condo with pool water 3′ from living room/family room and cement pool decking as close as 3″ from the living room (HOA refers to this as a “party wall”). The water flooded the neighbor’s yard, too, but none went in home so no real damage to his home. Our home appears to be slightly a lower elevation. Can they deny this claim as “groundwater”?
2-His liability insurance (Allstate) accepted responsibility. We got 2 contractor estimates. They want to send us a check for 15% less than one contractor and 42% less than the other contractor to settle claim. This is not enough for repair in Sacramento.
3-Our HOA policy has a $50,000 deductible for water claims. Allstate recommended we file with the HOA. Whose benefit is that?
What do we do? How do we fight these companies and just get our home repaired? It was bought in summer of 2022 and just remodeled so we wouldn’t have to do any repair or updating. USAA isn’t returning calls (3 times). I thought USAA would go to bat for us since they are our company (auto, homeowners, umbrella, flood). Help?
