Perils Insured against – smoke damage has been deleted in its entirety

I need clarification on the language received by my insurance adjuster. “The California FAIR Plan Association acknowledges receipt of your claim for damage to your property. There is a question as to whether the California FAIR Plan is obligated under the policy to provide coverage.” “Smoke Damage. c. Has been deleted in its entirety.”

Hi Helen, we feel your frustration with your carrier. You have options and absolutely should not count on your adjuster’s coverage interpretation at this point. Without further information, we would recommend that you do the following:

-Follow up with your carrier to ask for a copy of your policy (if you haven’t already). And make sure that the policy FAIR provides is the one that is in effect for the date your damages.

-Request a letter in writing from your carrier, outlining where and why (in the policy that covers your fire) your policy does not provide coverage for smoke damages resulting from a fire.

-File a formal complaint with the Department of Insurance

-Consider hiring an insurance professional, such as a Public Adjuster or attorney if you cannot make headway with your carrier

-Appeal the coverage decision by your carrier
