It’s been 11 months since I was rear-ended by a commercial van, yet to this day they still have not paid me for anything. Only a very small check that was nowhere near enough and a clause that it would revoke their full liability when cashed. I’m not stupid, that check got ripped up and thrown away. They owe for loss of use and repairs and a rental to be provided. Yet I can’t get anywhere with them because they use a third party administrator who is incapable of doing anything right.

SJ, the main thing is to put your important communications in writing, especially when you are submitting your evidence. When you send a letter with a request, put in the letter that you would appreciate a written response in the next seven days. If they don’t respond, send a follow up letter with another reasonable response date. If all else fails, take a look at your state’s small claims court process. Good Luck.
