In its amicus brief, United Policyholders argues that lawsuits seeking reimbursement under liability insurance policies for medical, addiction-treatment, and other costs caused by opioid addiction and overdose seek “damages because of bodily injury.” UP argues that while insurance policies require a causal connection between the bodily injuries and the damages sought, courts should not add limitations that do not appear in the policy language. UP further argues that, at minimum, conflicting decisions from courts around the country demonstrate ambiguity that must be construed in favor of coverage.
